This item is a bound document recording the protracted dispute between Colonel John Erskine of Carnock (and carried on by his son on his death in 1743) and General George Preston of Valleyfield. The dispute concerned Inzevar/Inzever Damm [Inzievar Dam], described as a mile long and covering some 60 acres of ground on Erskine’s property. Erskine stated that his coalworks at Torryburn were ‘intirely drowned… for want of the Use of this Dam’ because of Preston’s decades-long use of the water for Valleyfield ‘Coaliary’. Papers dating back to 1680 had been recovered, that Erskine stated showed the heritors of Preston had not possession but only a ‘Tolerance’ to use the water of Inzievar Dam. Preston stated that Valleyfield coalworks had been served ‘Time out of Mind’ by Inzievar Dam water and that Valleyfield estate would not have been bought in 1708, nor the aqueduct repaired, if he was not entitled to use the dam-water. The document contains details of witnesses in the case as well as information on local estates.
